These Terms of Service ("Terms") govern your access to and use of www.divinebyminya.com (the "Site") and any coaching, mentorship, or one-on-one program services offered by Divine by Minya ("we," "us," "our"), regardless of where in the world you are located, including the United States, the European Union, the United Kingdom, and elsewhere.
By visiting the Site, booking a session, or enrolling in any program, you agree to be bound by these Terms. If you do not agree, please do not use the Site or Services.
We may update these Terms from time to time. Continued use of the Site or Services after changes are posted means you accept the revised Terms.
1. Eligibility
By using our Services, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter into a binding agreement. Our Services are intended for adults seeking personal, professional, or life coaching support.
2. Nature of Our Services
Divine by Minya provides coaching, mentorship, and related educational or motivational services. Please read this section carefully:
- Coaching is not therapy, medical treatment, or licensed counseling. We are not a substitute for medical, psychological, legal, or financial professionals. If you are experiencing a medical or mental health crisis, please contact a licensed professional or emergency services in your area.
- No guarantee of results. Coaching outcomes depend on your individual effort, circumstances, and participation. We do not promise or guarantee specific results, income, transformation, or success from participating in our programs.
- Your responsibility. You are responsible for your own decisions, actions, and wellbeing during and after coaching sessions. Any advice, strategies, or exercises shared are suggestions only, not directives.
3. Booking, Payments, and Fees
- Session and program fees are listed at the time of booking and are due in full or according to the payment plan agreed upon at enrollment.
- Payments are processed securely through our third-party payment provider(s). We do not store your full payment card details.
- All fees are non-refundable except as described in our Cancellation & Rescheduling policy below, unless otherwise agreed in writing.
- Prices are subject to change at our discretion; changes will not affect sessions or programs already booked and paid for.
4. Cancellations, Rescheduling & No-Shows
- Clients may reschedule a session by providing at least 24 hours' notice via email or the booking platform.
- Cancellations made with less than 24 hours' notice, or no-shows, may be charged in full and are not eligible for a refund or credit.
- We reserve the right to reschedule sessions due to illness, emergencies, or unforeseen circumstances, and will provide as much notice as possible.
5. Program Access & Intellectual Property
- All coaching materials, worksheets, frameworks, videos, templates, and content provided as part of our programs ("Program Materials") are the intellectual property of Divine by Minya and are protected by copyright and other applicable laws.
- Program Materials are licensed to you for personal use only. You may not copy, distribute, resell, publicly share, or use Program Materials for any commercial purpose without our prior written consent.
- Unauthorized sharing or reproduction of Program Materials may result in termination of your access without refund.
6. Confidentiality
We treat information shared during coaching sessions as confidential and will not disclose it to third parties except:
- Where you give explicit consent,
- Where required by law, court order, or to prevent harm to yourself or others,
- Where necessary to provide the Service (e.g., to a payment processor or scheduling tool).
We ask that you likewise respect the confidentiality of any group coaching participants, if applicable, and refrain from sharing others' personal information shared during group sessions.
7. Client Conduct
You agree not to use our Services to:
- Engage in unlawful, harassing, abusive, or discriminatory behavior toward us or other participants
- Record sessions without prior mutual consent
- Misrepresent your identity or provide false information during intake
- Resell, sublicense, or misuse access to coaching sessions or materials
We reserve the right to terminate your access to the Services, without refund, for violation of these conduct expectations at any time.
8. Disclaimer of Warranties
The Site and Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
9. Limitation of Liability
To the fullest extent permitted by law, Divine by Minya, its owner, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, income, goodwill, or data, arising from your use of the Site or Services, even if advised of the possibility of such damages.
Our total liability for any claim arising from these Terms or the Services shall not exceed the amount you paid for the specific service giving rise to the claim.
Nothing in these Terms limits liability that cannot be excluded under applicable law.
10. Third-Party Tools & Links
Our Site may use third-party tools for scheduling, payments, or communication (e.g., Squarespace, Stripe, Calendly), and may contain links to third-party websites. We are not responsible for the content, policies, or practices of any third-party service or website.
11. International Clients
We welcome and serve clients worldwide. By enrolling in our Services from outside our home jurisdiction, you acknowledge that:
- Local laws in your country may differ from those referenced in these Terms;
- It is your responsibility to ensure our Services are appropriate and permitted for use in your location;
- Currency conversion, taxes, or transaction fees related to international payments are your responsibility unless stated otherwise.
12. Indemnification
You agree to indemnify and hold harmless Divine by Minya and its owner, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms or misuse of the Services.
13. Termination
We reserve the right to suspend or terminate your access to the Services at our discretion, including for breach of these Terms, without refund of any fees already paid, except where required by law.
You may discontinue use of our Services at any time; however, this does not entitle you to a refund of fees already incurred, except as described in Section 4.
14. Governing Law
These Terms shall be governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles, unless otherwise required by mandatory consumer protection laws in your country of residence.
15. Entire Agreement
These Terms, together with our Privacy Policy and any program-specific agreements you sign, constitute the entire agreement between you and Divine by Minya regarding your use of the Site and Services, superseding any prior agreements or communications.
